ARBITRATION ETHICAL RULES

OF BINH DUONG INTERNATIONAL AGREEMENT CENTER

In force as from January 1st, 2023

Rule 1. Righteousness

The Arbitrator must ensure impartiality, objectivity, independence and fairness throughout the arbitration proceedings:

– Not prejudice against the parties, witnesses and about the dispute that affects the decision to properly settle the dispute;

– Not giving opinions on dispute settlement before being selected or appointed as Arbitrator;

– The Arbitrator can introduce their profession and experience, but must not entice the parties to be selected as arbitrators to participate in dispute settlement.

– The Arbitrator may not accept gifts or benefits of any kind from any party to the dispute.

– During the proceedings, the Arbitrator may not meet or communicate privately with any party, or the lawyer or representative of any party to discuss issues related to the dispute.

– When settling a dispute, the Arbitrator must be independent and objective, based only on the law and the facts in the dispute, not under the influence of any organization or individual; must ensure fairness for all parties to present evidence and arguments on matters relevant to the dispute.

Rule 2. Publicity

The Arbitrator must disclose to the Binh Duong International Arbitration Center and the parties:

– Information about close personal relationships or business relationships in the past or present, directly or indirectly, with the parties to the dispute or with their representatives or with potential become an important witness in the dispute;

– Information about the dispute that the Arbitrator has from before being selected or appointed as Arbitrator.

– Other information that may raise doubts about your impartiality, objectivity and independence.

Rule 3. Confidentiality

The Arbitrator must keep the content of the dispute confidential and must not use information related to the dispute to benefit themselves or others or to disadvantage others.

Rule 4. Dedication

The Arbitrator accepting dispute settlement must ensure having sufficient capacity and time to settle the dispute.

During the dispute settlement process, the Arbitrator must personally study the file with the highest efficiency in order to properly and quickly settle the dispute.

When accepting to act as an Arbitrator, the Arbitrator is only entitled to remuneration according to the regulations of the Binh Duong International Arbitration Center, not to enjoy or agree with any other party on remuneration and other expenses./.
